In order to provide for a mutually beneficial relationship, The Mountain State Mystery Train has established an alternative mediation program in the event of a misunderstanding or dispute between us and our clients.”
CONSUMER DISCLOSURE NOTICE
[PART OF CONTRACT OF SERVICE]
PLEASE READ THIS NOTICE. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL RELATED SERVICES. PLEASE CHECK YOUR DOCUMENTS WHEN YOU RECEIVE THEM. CALL THE MOUNTAIN STATE MYSTERY TRAIN IF YOU HAVE ANY QUESTIONS
 The Mountain State Mystery Train (herein "Travel Agency") is acting as a mere agent for SUPPLIERS in selling travel-related accepting services, or in accepting reservations or bookings for services that are not directly supplied by this Travel Agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). Travel Agency, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers' companions or group members.
Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, Travel Agency does not guarantee any of such supplier's rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects. Travelers have done due diligence, are aware of the quality of the hotel accommodations chosen, and agree that Travel Agency will not be responsible if they are not satisfied.
Mediation and Arbitration
     If a dispute arises out of or relates to this contract, or breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the World Travel Dispute Center under the applicable guidelines as established by International Forum for Travel and Tourism (IFTTA) before resorting to arbitration, litigation, or some other dispute resolution procedure. If mediation is not successful, the parties will settle by binding arbitration administered by the World Travel Dispute Center under the applicable guidelines as established by IFTTA. Judgment on the award rendered by the arbitrator(s), or written agreements of the parties, may be entered in any court having jurisdiction thereof or written agreements of the parties. If litigation is necessary to enforce this agreement, the prevailing party(s) shall receive costs and attorney’s fees.
Risks, Cancellations and Insurance.
The Mountain State Mystery Train shall not be responsible for any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, local laws, terrorists acts, climatic conditions, Acts of God, delays, changes or cancellation of travel due to weather conditions, hotel services, accidents or health related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, or any other actions, omissions, or conditions outside of The Mountain State Mystery Train’s control.
If travel plans are delayed or cancelled for any reason there will be no refunds issued by The Mountain State Mystery Train.  There will be no refunds for cancellations made 90 days or less before departure, including cancellations due to actual or threatened terrorist events.  There will be no refunds due to fear of travel from actual or threatened terrorists events. 
It is the traveler’s responsibility to protect their purchases and Travel Insurance is strongly recommended. Traveler is advised to obtain appropriate insurance coverage against these risks; information is available through this Travel Agency regarding travel insurance. Traveler's retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.
By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency.

 

 

Rail Excursion Ticketing and Boarding Information
 PLEASE READ THIS NOTICE. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL RELATED SERVICES. PLEASE CHECK YOUR DOCUMENTS WHEN YOU RECEIVE THEM. CALL THE MOUNTAIN STATE MYSTERY TRAIN IF YOU HAVE ANY QUESTIONS

 

  1. You have chosen our (Name of Travel Package) Rail Excursion Package departing (city and state)  on  (date and time) from the Amtrak Passenger Station located at (address).
  2. This exciting excursion package includes (brief description of what tour includes)
  3. Please be at the Amtrak Station thirty minutes before the scheduled departure time.  Ample parking is available on a first come, first served bases at the train station.
  4. Your invoice will be your Boarding Pass.  You do not need to check in with the agent at the station.  A tour guide / representative of The Mountain State Mystery Train will be at the station to assist you with your registration and check in.
  5. Please review all ticketing and boarding information carefully.
  6. We reserve the right, at our sole discretion, to alter the timetable, mode of transportation and destination, if necessary, without advance notice, due to circumstances beyond our control.
  7. Should all or any portion of a reservation be cancelled after purchase there is no refund.  Passengers will be provided a credit voucher giving them the option to transfer full value of ticket(s) purchased, without penalty, as a courtesy, into any of our scheduled public charters for up to one year from the date of their originally scheduled departure date, at anytime after the purchase of seating aboard any of our public charters, year round.
  8. All ticketed passengers agreed that they have read, understand and agree to be bound by the complete set of ticketing documents, including but not limited to terms/conditions of sale and established policies governing all ticketed passengers, without exception, as attached to and made a part of their ticketing documents.

 

Important Passenger & Guest Tour / Excursion Policies
PLEASE READ THIS NOTICE. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL RELATED SERVICES. PLEASE CHECK YOUR DOCUMENTS WHEN YOU RECEIVE THEM. CALL THE MOUNTAIN STATE MYSTERY TRAIN IF YOU HAVE ANY QUESTIONS

 

  1. Baggage is not limited but the number of bags should comply with carrier policies and restrictions.
  2. Cancellation – 1) We have no right to cancel the charter less than 10 days before departure, except for circumstances that make if physically impossible to perform the charter trip including but not limited to inadequate occupancy of ticketed guests. 2) If for any reason you should need to cancel your excursion, your cancellation must be in writing and must be in advance of or prior to departure.  A telephone cancellation will not be recognized.  Your cancellation request will be limited to the rights and remedies contained within our cancellation policies and not otherwise.
  3. Children – Children under 18 must be accompanied by an adult on the excursion
  4. Clothing – Comfortable, weather appropriate attire is recommended as well as comfortable, flat, sure footed shoes.  Certain destinations may have clothing restrictions, consult us for details.
  5. Communication – Limited telephone service may be available on some excursions.
  6. Deposit – Consult booking / reservations specialist for any deposit that may be required for excursion.
  7. Diet – Each menu has at least one “Heart Smart” meal and special diets can usually be accommodated with seven days notice.
  8. Embarkation Time – Boarding information will be sent with your confirmation and travel documents.
  9. Handicapped – The handicapped are welcome to travel with The Mountain State Mystery Train, however, since very limited wheelchair accessible accommodations are available advance notice is required. 
  10. Health Considerations – Doctor and pharmaceutical services are not available on the excursions so come prepared if you have special medical or pharmacy needs.
  11. Notification – Every effort will be made to adhere to information given you by The Mountain State Mystery Train.  However, we reserve the right in our sole discretion to alter schedules, departure or arrival times and hotels without advance notice.  We will serve as an intermediary to arrange travel services.  The Mountain State Mystery Train is not an agent of the passenger or those providing other services offered and accordingly holds itself free of liability for any injury, personal or otherwise from any cause whatsoever.
  12. Parking – Parking is available near your boarding point, but is not considered a part of your ticketing.  Passengers are advised that they park vehicles at their own peril and risk.
  13. Pets – Pets are not permitted on the excursions.
  14. Refunds – No refunds will be made.  Passengers will be provided the option to transfer full value of tickets purchased, without penalty, into any of out scheduled public excursions for up to one year from their originally departure date.  The passenger’s rights and remedies regarding cancellations or refunds are clearly explained, no alterations or modifications other than contained herein will be considered.
  15. Alternative Transportation or Equipment Substitution – we reserve the right to provide alternative transportation to or from our destination when circumstances or conditions occur that are clearly unforeseen or beyond our control  Therefore, equipment changes or substitutions may become necessary and will be provided whenever possible
  16. Safety and Health – For your safety we request you wear flat, sure footed shoes.  Medical professionals are not available as a apart of our packages, passengers are strongly urged to consider their circumstances prior to securing tickets.  Should a medical emergency arise, every effort consistent with the policies of our carriers will be made to secure medical attention.  Passengers are requested to consider their individual issues of mobility as many of our excursions require walking, climbing of stairs, etc.  Passengers are also required to adhere to the various safety and health policies of our various carriers
  17. Seating – All seating is reserved and seating assignments are made on a first come first served bases.  All efforts will be made to seat families and other groups together when possible.  Groups should make their request for seating when purchasing their tickets.
  18. Travel Insurance – is available at an additional cost and is not included as a part of your ticket purchase. 
  19. Unused Tour Services – No refunds will be made for unused tour services, nor is the price or value of unused travel services exchangeable for alternative arrangements except as provided for per the cancellation policy listed in the Ticketing and Boarding Information
  20. Alcoholic Beverages – Our policy for the consumption of any alcoholic beverages is governed by the policies of our various common carriers and travel providers, host destinations and firm policies for specific chartered tour / operations
  21. General – Information contained in this document represents the general conditions and circumstances of our tour excursion operations.  Our policies include but are not limited to all information contained herein.
